Jared Kushner’s Diplomacy and Foreign-Backed Business Interests
Jared Kushner served as a senior adviser in Donald Trump’s first administration, developed close relationships with Gulf leaders, and established Affinity Partners after leaving government. Saudi Arabia’s sovereign wealth fund committed $2 billion to his funds. During Trump’s second term, Kushner has returned to high-level negotiations while retaining his investment business. Congressional inquiries and a newly filed lawsuit focus on the overlap between diplomatic authority, foreign-backed investments and financial disclosure.
Kushner, Trump’s son-in-law, was a formal White House senior adviser during 2017–2021. His work included Middle East diplomacy, relations with Saudi Crown Prince Mohammed bin Salman, and the 2020 Abraham Accords. The September 15, 2020 White House ceremony documented agreements involving Israel, the United Arab Emirates and Bahrain and credited Kushner among the negotiators. These were regional normalization agreements; Saudi Arabia did not join them.
Affinity was established in 2021. The Saudi Public Investment Fund committed $2 billion within roughly six months of Kushner leaving office. Reporting based on investment-panel records described objections concerning his team’s investment experience, due diligence, risk concentration and fees. The PIF board, chaired by the crown prince, approved the investment despite those objections.
Senate Finance investigators reported in September 2024 that Affinity had received up to $157 million in foreign-client fees, including $87 million from Saudi Arabia. The Saudi commitment carried a 1.25% annual management fee: $25 million a year by arithmetic on $2 billion. The Saudi $87 million is part of the $157 million, not an additional amount. The committee reported no investor earnings distributions and no generated investment return as of July 2024; that is a dated finding, not a description of all subsequent performance.
Reuters reported that a further $1.5 billion from Qatar’s sovereign wealth fund and Abu Dhabi-based Lunate helped increase managed assets to $4.8 billion at the end of 2024. Kushner said the fundraising closed before Trump’s reelection. Reuters identified him as sole owner of A Fin Management LLC, the investment adviser behind Affinity. Investor commitments and managed assets are distinct from his personal wealth; fees are revenue to the business he owns.
Kushner has participated in negotiations concerning Gaza, Russia–Ukraine and Iran. Reuters described him and Steve Witkoff handling Iran and Ukraine talks on the same day in February 2026, with former officials questioning their capacity and the reduced support from experienced diplomatic institutions.
The White House describes Kushner as a private citizen volunteering at Trump’s request and paying his own expenses. That differs from his formal, disclosed first-term employment. It also differs from saying he has no presidential authorization: he is representing Trump in negotiations, while the legal status and obligations of that role are contested.
Gulf investors and diplomacy. Saudi Arabia, Qatar and the UAE supply investment capital while also being central to regional negotiations. In October 2024, Senators Ron Wyden and Representative Jamie Raskin requested a special-counsel inquiry into possible unregistered foreign-agent activity, citing Kushner’s continuing Saudi diplomatic discussions. Kushner denied a conflict; Affinity rejected the allegations.
Fresh fundraising during the second term. An October 5, 2026 letter from House Oversight ranking member Robert Garcia cites March reporting that Kushner was seeking at least $5 billion in foreign capital while negotiating in the Middle East. This is a reported fundraising target, not a verified receipt of $5 billion.
Phoenix Financial and military suppliers. Garcia’s letter, citing CNN’s October 1 investigation, says Affinity is Phoenix Financial’s largest shareholder and Phoenix held more than $456 million in nine businesses supplying Israel’s military, including Elbit Systems. The ownership chain is Affinity → Phoenix → supplier investments. These holdings are not equivalent to Kushner directly owning every supplier. Garcia requested transaction records, safeguards and details of Kushner’s travel and meetings.
Actual investment proceeds. Affinity and Phoenix announced on July 27, 2026 that Affinity sold 25% of its Phoenix holding, enabling it to return its original investment to limited partners, while retaining 7.4% of Phoenix and remaining its largest shareholder. They reported an approximately fivefold increase in Phoenix’s value including dividends since the initial investment. These are issuer-reported investment results, separate from management fees and Kushner’s personal distributions.
Potential appointment and disclosure conflict — litigation filed October 14, 2026. CREW’s complaint, case 1:26-cv-03580, argues Kushner exercises continuing government authority requiring lawful appointment and public financial disclosures. It also argues that delegating such authority to a private citizen is unlawful. These are the plaintiff’s legal claims; the filing is not a judgment.
An employee is prohibited by criminal statute, 18 U.S.C. 208(a), from participating personally and substantially in an official capacity in any particular matter in which, to the employee's knowledge, the employee or any person whose interests are imputed to the employee under this statute has a financial interest, if the particular matter will have a direct and predictable effect on that interest. 5 CFR §2635.402(a)
Financial-interest rule relevant to the diplomatic and investment overlap.
The unresolved application requires establishing his covered governmental status, the particular decision and its direct financial effect, and any applicable exemption or waiver. The complaint separately invokes Article II’s Appointments Clause and the Ethics in Government Act.
Kushner’s attorney Chad Mizelle says outside and government ethics lawyers reviewed the arrangement and found it compliant, and disputes CREW’s standing. The White House says Kushner’s business activities are separate from his diplomatic engagements. Those are the responses to retain beside the complaints.
Foreign-government representation: FARA (22 USC §§611–613) turns on an agency relationship and covered conduct, not merely receipt of foreign capital. The Justice Department says bona fide private, nonpolitical commerce can be exempt, including some state-owned-enterprise activity; government-directed political activity is different. This is the question behind the Wyden/Raskin request concerning Saudi diplomacy, not a finding that every Affinity investment requires registration. DOJ guidance .
Leaving office and the 2021 Saudi investment: 18 USC §207 restricts specified post-employment representation, including some communications on matters personally handled in office and certain foreign-government assistance within one year for covered senior personnel. Fundraising alone does not resolve those elements. The 2021 record needs exact communications, capacity, counterparties and dates; the one-year clock does not restart merely because reporting occurs in 2026. Statute .
Payments tied to official acts: 18 USC §201(b) addresses corrupt exchanges for official action, while §201(c) separately addresses prohibited things of value for or because of official acts. Its public-official definition includes a person acting for or on behalf of the United States in an official function. An unpaid label is not, by itself, a complete answer under this statute. The investment chronology is recorded; a corrupt exchange or act-linked gratuity requires its own evidence. Statute .
Legal review boundary: Actions recovered in this scan were screened by category against relevant U.S. law. This is not an exhaustive legal audit of uncollected contracts, confidential negotiations or private travel. Red-marked material identifies a supported potential conflict, not a conviction.
Investment transactions and foreign projects: Purchases such as EA may require foreign-investment and antitrust review; a closing announcement alone does not reveal every regulator's findings or Kushner's contacts with them. The Albania and Serbia files raise host-country permitting and heritage questions, but this scan did not obtain evidence of a Kushner payment to a foreign official to secure business that would support a U.S. foreign-bribery allegation. Sanctions questions in Russia-related proposals likewise require an actual transaction, parties and license terms. No criminal violation is assigned from geography or association.
Material response: In his published response to The New Yorker, Kushner says he has raised no further Affinity funds since Trump's reelection; that early fundraising conversations ended when his volunteer service extended; and that he never directed Phoenix's underlying defense-company investment decisions. He denies taking diplomatic action to benefit Affinity or its investors. These claims are retained alongside the congressional allegations, not substituted for transaction records. His full response .
Role update: The White House's January 16, 2026 statement names Kushner to the Board of Peace's founding Executive Board. That documented role must be preserved alongside the administration's volunteer/private-citizen description and the pending legal dispute. Official statement .

Albania / coastal resorts. Projects active/disputed in 2025–26. Kushner-linked development interests; Albanian government permissions. Sazan and coastal projects; reported valuations cover different project scopes. Environmental protests and government approvals tracked. Project location is not itself evidence of a dated personal visit. Do not combine $1.4bn island proposal and broader €4bn coastal estimates.
Serbia / Belgrade redevelopment. 99-year lease in 2024; withdrawal reported Dec 2025. Serbian government ↔ Affinity Global Development. Hotel, apartments, shops and offices; former army HQ. Withdrawn project, not current operating asset. Domestic indictments concerned Serbian officials; do not assign their charges to Kushner.
United States / Warner Bros bid. Dec 2025 bid; subsequent withdrawal reported. Affinity proposed financing alongside Paramount/Gulf backers. $108bn was total bid, not Affinity investment. Initial participation reported by Reuters. Later withdrawal reported by Axios; no current holding claimed.
United States / Mosaic solar finance. Pre-second-term investment; present status unresolved. Affinity → Mosaic. Politico reported >$100m and >10% in 2024. Retained lead; 2025–26 restructuring, losses and current ownership not verified in this scan.
2026 fundraising claim. March reporting; October response. Potential Fund 2; PIF first-look discussions. Reported $5bn target; disputed characterization as money raised. Kushner says no additional funds raised since Trump's reelection and discussions stopped when his volunteer role extended. Full reconciled cash receipts not obtained.
